A lawyer has the right to refuse to take a case on a contingency basis if he thinks he won't make money from it. Perhaps if you do some searching you can find a consumer advocate organization that will pursue the case simply to get rid of incompetent doctors rather than for money. There is nothing preventing you from hiring an attorney on an hourly basis if you want to punish the doctors involved.
